2.1 Acceptance of conditions

For the Internet user (referred to as “the user” or “you”), simple access to the https://extensions.macymed.fr site implies unreserved acceptance of all the conditions described herein and an undertaking to respect them.

We may use your personal data for commercial prospecting purposes, and in particular to send you information on our products/services, commercial and promotional offers, quotations and other pre-contractual documents, and news by post. 6. The basis for processing your personal data

7. How and for how long we keep your personal data

We manage your personal data in three phases:

• An active phase where data is kept for the time indicated below in an “active” database: your personal data is then only accessible to those who have an operational need to access it in order to carry out authorized processing.
• An archiving phase (for a period in addition to the storage period in the “active” database) when justified by a legitimate reason: your personal data is then archived with restricted access and for a limited period.
• A deletion or anonymization phase: at the end of the additional archiving period, your personal data is deleted or anonymized (so that it can no longer be used to identify you personally).

Your personal data is kept for the time required to process it, for our customer relations where applicable, and for the performance of contracts, and within the limits specifically laid down by regulations. 8. Withdrawal of your consent to the collection or processing of your personal data

Your consent to the collection of your personal data may be withdrawn by writing to our DPO by email or by post to the address below, stating your surname, first name, email address and the precise nature and purpose of your request for withdrawal.

9. Exercising your rights regarding your personal data

With your consent, you can :

• A right of access, which allows you to obtain :
  • Confirmation that your data is or is not being processed;
  • Communication of a copy of all personal data held by the data controller.
• A right to request data portability: this allows you to recover your personal data in a structured, commonly used and machine-readable format.
• A right of opposition: this allows you to opt out of commercial prospecting by us or our partners, or, for reasons relating to your particular situation, to stop the processing of your data for the purposes of research and development, the fight against fraud and prevention.
• A right of rectification: this allows you to have information about you rectified if it is obsolete or erroneous. It also enables you to have incomplete information about yourself completed.
• A right of deletion: this allows you to obtain the deletion of your personal data, subject to the legal retention periods. This right may apply in particular if your data is no longer required for processing.
• The right to lodge a complaint with a competent supervisory authority.
• A right of limitation: This allows you to limit the processing of your data in the following cases:
  • In the event of unlawful use of your data ;
  • If you dispute the accuracy of your data ;
  • If you need the data to establish, exercise or defend your rights. In this case, the data will no longer be actively processed, and may not be modified while this right is being exercised.
• A right to human intervention: data controllers may use automated decision-making to underwrite or manage your contract. If this is the case, you can ask the DPO what criteria were used to make the decision.

Macymed undertakes to respond to your verified request within one month of receipt. If necessary, we will ask you to prove your identity by providing a photocopy of a valid, signed identity document.

In the event of difficulty, you can also contact the Commission Nationale de l’Informatique et des Libertés (CNIL).

Please note, however, that a restriction or deletion of data could mean that we would no longer be able to provide you with information, services or products that you would like to benefit from.

10. Our subcontractors and partners

Macymed may transmit your personal data to subcontractors carrying out services involving the processing of your data and in compliance with the purposes set out herein; these subcontractors must provide your personal data with the same level of confidentiality as Macymed and have undertaken to comply fully with the regulations on personal data, in particular with the RGPD. We do not trade in your personal data; if you would like to know more and specifically the identity of the service providers or partners to whom your personal data has been transmitted, you can contact our DPO at the following address: extensions@macymed.fr. Service providers or partners likely to have access to your personal data may include :

• service providers likely to manage outsourced services for the execution of our services and contracts;
• service providers who help us improve our services, carry out data analysis and optimize our offers, conduct surveys and statistics;
• auditors, chartered accountants, consultants, lawyers, auditing firms, IT and outsourcing service providers, security service providers;
• investors and buyers.

We may also transmit your personal data to the French authorities, administrations and jurisdictions, in particular in the context of legal proceedings or legal formalities requiring such communication.

12. Confidential information

Macymed undertakes to ensure that Confidential Information provided by its customers :

Shall be protected and kept strictly confidential, and shall be treated with the same degree of care and protection as Macymed accords to its own Confidential Information of equal importance;

Is disclosed only to those members of its staff who need to know it and is used by them only for the purpose defined in advance by written consent from our customers;

Not be copied, reproduced or duplicated in whole or in part, unless such copying, reproduction or duplication has been specifically authorized in writing by our customers.

All Confidential Information and its reproductions, transmitted by our customers to Macymed, will remain the property of our customers and must be returned to them on request.

Macymed undertakes to return, on request, any confidential documents that our customers may have given us, within the framework of the contract signed with them, without keeping any copies.

Ownership of all Confidential Information that our customers disclose to Macymed under any agreement shall in any event belong to our customers, subject to the rights of third parties.

13. Applicable law

This policy is governed by French law and is subject to the jurisdiction of the courts of Paris, the location of the Macymed Group’s registered office, unless specific jurisdiction is conferred by a particular legal or regulatory text.
